Legal Framework Established for the Operations of the International Center for Digital Technologies

The Law establishes new legal mechanisms directed at developing the digital technology sector in Uzbekistan, creating innovative products and services, attracting foreign investment, and expanding the export of digital services.
Under this Law, the status of the International Center for Digital Technologies as a distinct territory is defined, along with the foundations of the special legal regime applicable within its territory.
The document envisages the creation of a special legal environment for developing and implementing innovations in the field of digital technologies, testing new products and services, attracting investment, and stimulating export activity.
A "Regulatory Sandbox" to Be Introduced for Innovation
One of the key areas of the Center's operations will be the "Regulatory Sandbox" mechanism, which enables the practical testing of innovative technologies and business models.
Through this mechanism, separate legal conditions will be established for the practical testing of new technologies, products, and services. Within the framework of the "Regulatory Sandbox," temporary relaxed or simplified requirements may be applied, and special regulatory platforms, zones, and laboratories may be established for testing innovative solutions.
This approach will allow innovative companies to test new products in a controlled environment prior to their full-scale launch, improve existing procedures, and introduce new technologies into practice.
A Legal Environment Aligned with International Standards
A special legislative regime is envisaged to apply within the territory of the Center.
The special legal regime established under this Constitutional Law shall remain in effect until 2100. It shall apply to the types of activity approved by the Governing Council.
In addition to the Constitution of the Republic of Uzbekistan and this Constitutional Law, decisions adopted within the scope of the Center's authority shall also constitute an important legal basis.
Furthermore, in cases of necessity, and provided such use does not conflict with the Constitutional Law or the decisions of the Center, provision is made for the application of the common law of England and Wales, together with the principles and rules of equity.
The Center's decisions are to be developed on the basis of advanced international practice and standards, with English established as the official working language.
This mechanism is intended to serve the formation of a clear, stable legal environment closely aligned with international practice for local and foreign companies operating within the Center.
New Opportunities for Investors
Particular attention is given, under the draft Constitutional Law, to the development of investment activity within the territory of the Center.
Among the Center's principal objectives are the creation of favorable conditions for attracting investment, the establishment of mechanisms to protect the rights and legitimate interests of investors, and the development of an ecosystem for venture capital and other forms of alternative investment.
The Center provides for categories such as institutional investors, startup investors, resident investors, and infrastructure investors.
A separate mechanism is being established specifically for startup investors. Any natural or legal person making a direct investment in a startup project within the Center's territory shall be recognized as a startup investor. Tax and customs benefits provided for under the Constitutional Law shall apply to income derived from such investments, including dividends.
Guarantees for Investor Rights
The document also gives particular attention to protecting the rights of Center participants in connection with their investment activities.
Accordingly, participants of the Center shall have the right to independently determine the volume, type, form, and direction of their investments, and to freely dispose of income derived from investment activity.
Ensuring long-term legal protection for investors and investments, and establishing guarantees for the inviolability of private property and investments, are among the responsibilities assigned to the Governing Council.
Favorable Conditions for Attracting Foreign Specialists
A number of opportunities are also envisaged within the Center for attracting highly qualified foreign specialists in the field of digital technologies.
In particular, the Center's bodies and participants shall have the right to engage foreign nationals and stateless persons in their activities. Entry visas for foreign employees and their family members may be issued for a period of up to three years.
At the same time, foreign employees hired by the Center's bodies and participants shall be exempt from the requirement to obtain a work permit authorizing labor activity within the territory of Uzbekistan.
The employment, registration, and recordkeeping of foreign employees shall be carried out through the Center's digital platform.
The Center's Governance System
Pursuant to the Constitutional Law, the Center's principal bodies shall consist of the Governing Council and the Center's Administration.
The Governing Council is defined as a collegial body responsible for determining the strategic direction of the Center's activities and exercising senior-level management. The Center's Administration, in turn, is the executive body responsible for ensuring the Center's operations.
The Governing Council shall have authority to define priority areas for the Center, improve the special legal regime, establish mechanisms for investment protection, and create a stable legal environment for the Center's participants.
The Center's Administration, for its part, shall be responsible for providing informational and advisory support to participants, developing infrastructure, monitoring projects, and overseeing and evaluating testing processes conducted within the framework of the "Regulatory Sandbox."
A New Institutional Environment for the Digital Economy
Overall, the establishment of the International Center for Digital Technologies is aimed at forming a unified, special legal environment for innovative companies, startups, investors, and international specialists in the field of digital technologies.
Through this approach, the necessary legal foundation will be created for testing and implementing innovative technologies, increasing investment activity in the digital sector, developing an ecosystem for startups and venture capital investment, attracting foreign specialists, and stimulating the export of digital products.
